Research project Criminalization of torture at the domestic level – a victim’s approach

PhD research project that examines how states conceptualize torture in incorporating the crime in national legislation and the resulting effect on national prosecutions and redress for torture survivors, with a focus on European countries.

Today many perceive the fight against torture as a battle that has already been won. International and regional treaties encompass its prevention, prohibition, and redress with elaborated protection mechanisms.  Yet torture continues to be practiced with almost complete impunity throughout the world, both at the hands of state and non-state actors. There still remains disagreement and divergence in current international practice on the very conception of torture as a crime, such as whether it includes the actions of non-state actors or not. These differences have profound and very concrete repercussions for the prosecution of the crime at the domestic level, as well as for redress for victims. These effects will be examined in this research project.
